Terms of Service

These terms govern your use of Event Photos Plus (the “Service”; “we” and “us” mean Event Photos Plus). By creating an account or using the Service you agree to these terms.
1. The Service
Event Photos Plus is a photo delivery platform for event and headshot photographers (“Studios”). Studios run sign-up queues and bookings, upload photos, and deliver private online galleries to their event guests (“Guests”), including optional paid retouching offers.
2. Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or disable accounts that breach these terms.
3. Subscriptions and billing
- Studio access is provided on a monthly subscription, billed in advance through Stripe.
- Prices are shown at checkout in Australian dollars. We may change pricing with reasonable notice; changes apply from your next billing cycle.
- You can cancel at any time; your subscription remains active until the end of the period already paid for. Except where required by law, payments are not refundable.
- If a renewal payment fails, access to job management is paused until billing is brought up to date. Guest galleries that have already been delivered keep working.
4. Retouching payments
Studios may offer paid retouching to Guests. Those payments are processed by Stripe directly into the Studio’s own Stripe account (via Stripe Connect or the Studio’s own API keys). The retouching transaction is between the Studio and the Guest; the Studio is responsible for delivering the retouched photos and for any refunds. We may charge the Studio a platform commission on these transactions, disclosed to the Studio in advance.
5. Your content
- Studios retain all rights in the photos and branding they upload. You grant us a licence to host, process, and transmit that content solely to operate the Service (for example serving galleries to Guests and generating email deliveries).
- The Studio is responsible for having the necessary permissions to photograph Guests and upload their images, and for its own agreements with its clients.
- Photos are retained according to the retention settings chosen per job or per Guest, after which they are permanently deleted. Deleted photos cannot be recovered; keep your own originals.
6. Acceptable use
You must not use the Service to store or distribute unlawful content, to send unsolicited bulk email, to infringe others’ rights, or to interfere with the operation or security of the Service.
7. Availability and changes
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify features over time. We perform nightly verified backups of Service data, but you should retain your own copies of original photos.
8. Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Otherwise, to the maximum extent permitted by law, our total liability arising out of the Service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential loss.
9. Termination
You may close your account at any time. We may terminate or suspend access for material breach of these terms. On closure, your data is deleted in line with our Privacy Policy and retention settings.
10. Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.
